Buying property in Turkey through  Hoca Emlak Ltd.is easier than you think and far more inexpensive than you may imagine.

Purchasing properties for private use in Turkey is not as complicated as you might think. The procedure is often far simpler than in most other European countries. Foreigners may purchase land and property in Turkey under their own names provided that the properties are located anywhere except restricted military zones and when the time comes to sell the proceeds of the sale may be transferred out of Turkey.( the official announcement)

The new owner of a property receives a “title deed -tapu- in Turkish. The Tapu is the official document proving ownership of a property. The Land Registry Office, which is a State Department is the only authority to transfer the title deed to your name. No other person or authority is able to transfer the title deed to your name. The title deed may be transferred once checks have been made to ensure the property meets all the necessary requirements.

Formalities step by step
When you have decided to buy your own property, you can start by opening a bank account and  Hoca Emlak Ltd. staff will be pleased to help you open a bank account at a local bank.

The buyer gives “attoney” to Hoca Emlak Ltd. staff, authorizing them to carry out all the formalities for the purchase and to give the buyer post purchase services. Power of attorney usually includes authorization to buy/register the property in the name of the buyer, to obtain a “completion report” for the property, official registration of water and electricity meters, insurance for the property, registration of property in the municipality department, payment of local taxes,

The property owner/developer and the buyer sign a “Sales Contract” before a Public Notary in most cases. This is an official document stating all the personal data of the seller and the buyer, details and the price of the property, payment conditions, date of the contract, special conditions etc...

An application is made to the Land Registry Office for starting the procedures for Military permission (For checking that the mentioned property is outside of any Military zone  Ege Ordu Kom. Normally this process may take several months). If required, all paper work will be done by Hoca Emlak Ltd.  and the expenses will be paid by the buyer.

Once the permission from the military is given, the property owner/developer and the buyer (or their legal representatives) go to the Land Registry Office to transfer the title deed to buyer’s nam

Conveyance:
In contrast to most European countries, the entry in the property register in Turkey is not performed by a Public Notary but by an official of the Property Registry Department. It is a legal requirement for both sides (the seller and the buyer) to be present at the entry. It is possible to authorise another person by giving a power of attorney by noter.. The delivery of the Title Deed of transfer does not require the intervention of a Notary Public in Turkey. After the entry and delivery the property register issues a proof of ownership, which is called the Tapu"
 

 
Conveyance tax:
3.3 % of the property value stated in the Tapu Office. This is paid at one of the State Banks at the time of conveyance (the amount stated in the Tapu Office is lower than the real property value and approximately between 200-500 Euros). 
 
Registration Fee at the Property Registry Department (Tapu Office):
Appr. 55 Euro. 
 
Completion Report:
Obtaining “Completion Report” (New built properties only). Starting from 350 Euros depending on the size and the location.


Lawyer Service Fee
If required,  service fee is 1% of the purchase price of the property minumum amount of 1.200 € + 18% VAT. Please ask for purchasing process details for your case and the legal entities.  

Annuall expenses

Property tax (Emlak Vergisi):
0.1% of the property value declared by the local municipality (to be paid before the end of May each year).

Insurance
Varies between 85 Euros to 200 Euros (depends on m2)
